Quick answer: If you qualify on income, savings or property, you apply at a Mexican consulate outside Mexico, even if you already live there most of the year. You cannot switch from tourist to resident at INM on money. The main exception is family: being married to, or the parent or child of, a Mexican citizen or a resident gives you a route inside the country. Everyone else plans one trip abroad for the consulate, then returns with the visa and finishes at INM.
Key takeaways
- Money does not open an in-country route. Income, savings and property cases all start at a consulate abroad.
- Family does. Mexico's migration law gives spouses, parents and children of Mexican citizens and residents a right to regularize.
- Time in Mexico counts for nothing here. Years of winters on a tourist permit build no rights.
- Owning a home is not residency. Even the property route is a visa application at a consulate.
- The visa lasts 180 days, so you can get it on your next trip home and come back when it suits you.
- Come back on the visa, not as a tourist. A tourist entry voids it.

Why you have to leave
A resident visa is issued by a Mexican consular office abroad. Inside Mexico, INM exchanges that visa for a card, in the step called the canje. If you have no visa, there is nothing to exchange.
Federal visa rules confirm the limit from the other side. INM takes visa applications only for family unity, a job offer or humanitarian reasons. Solvency is not on that list, so it goes to the consulate.
Who can apply from inside Mexico
The Ley de Migración (article 133) gives these people in Mexico a right to regularize their status:
- The spouse or partner of a Mexican citizen or of a foreign resident.
- The parent, child, legal representative or guardian of a Mexican citizen or of a foreign resident.
- People identified as victims or witnesses of a serious crime in Mexico.
- People in a situation of vulnerability that makes their return difficult or impossible.
- Children in an international restitution case.
If you are married to a Mexican citizen, you skip the money test too. The family unity guide covers that route and its documents. One difference to plan for: certificates filed at INM are treated as foreign documents, so they need an apostille and a translation.
Being married to another foreigner who has no status yet does not help. One of you has to hold residency first.
What this means if you winter in Mexico
Plenty of people spend four or five months a year in Mexico and assume that gives them some standing. It does not. A tourist stay is up to 180 days, set by the officer at the border, and it builds nothing towards residency.
The good news is that your yearly routine already includes the trip you need. If you go home for part of each year, your home-country consulate is on the way. A workable order looks like this:
- While you are in Mexico: work out your route, check your 12 months of statements, and look at your consulate's appointment calendar online.
- Back home: go to the consulate with your file.
- Next time you travel: enter on the visa, within its 180 days, and tell the officer you are coming for the canje.
- Within 30 days of entering: start the canje at the INM office that covers your Mexican address.
The timeline guide shows how long each stage takes if you have a date to work to.
What this means if you own property
Owning a home in Mexico does not give you residency, and you cannot apply at INM because of it.
There is a property route, but it is a visa route. The federal rules allow a Temporary Resident visa for someone who holds a notarized deed to property in Mexico worth more than 91,710 UMA days, about 10.76 million pesos. The deed is the evidence you take to the consulate. Below that value, your home does not help, and its equity cannot be added to your savings.
If you do own a home, your address for the canje is simple, and that is the only part it makes easier.
Do you have to go home, or can you use any consulate?
Federal rules say a visa may be processed at any consular office, but each consulate decides who it will see, and many expect you to live in their area. The Mexican Consulate in McAllen, for example, says it takes Texas residents only.
So a trip across the nearest border is not automatically a plan. Before you buy a flight:
- Find the consulate that covers your home address.
- If you want to use a different one, write to it and get a yes in writing.
- Remember that your statements still have to meet that consulate's own figure and format.
Already know you qualify?
Qualifying is the easy part; the file is what gets sent back. Roger Scott, who runs ResidencyMexico, went through it himself. On a 45-minute call he plans your route with you — which documents, in what form, and when to book — checks any documents you already have against your consulate's own list, and you leave with a written plan of your next steps.
If your tourist permit has expired
This is a different problem, and it should not wait for your next trip. If you have family ties, regularization may be open to you, usually with a fine. Either way, speak to an immigration lawyer in Mexico before you travel or go to INM, because the right answer depends on your dates and your family.
Common questions
Can I change from tourist to temporary resident inside Mexico? Not on income or savings. You apply at a Mexican consulate abroad, then finish at INM with the visa. The in-country route is for family ties and a few humanitarian cases.
I own a house in Mexico. Can I apply from here? No. Property does not open an in-country route. If it is worth more than 91,710 UMA days, it can support a visa application at a consulate.
I am married to a Mexican citizen. Do I have to leave? Usually not. Family unity can be done at INM inside Mexico, and you do not have to show income or savings. Certificates filed at INM generally need an apostille and an official translation.
My spouse is a foreign resident of Mexico. Can I apply here? The migration law gives the spouse of a resident a right to regularize. Ask your INM office what it needs from the resident spouse.
Can I apply at a Mexican consulate in Guatemala or Belize? Only if that consulate agrees. Many expect local residency, so get a written yes first. Do not book the trip on a forum post.
How soon can I return after the consulate? As soon as you have the visa. It is valid for 180 days and one entry. Enter on it and tell the officer you are coming for the canje.
Do years as a tourist count towards residency or citizenship? No. Time counts only from when you hold residency.
